I don’t know how different it can be in Canada, but here in Calif, if a Tenant signs a lease that specifically names the unit as a single person unit and forbids additional tenants, and the Tenant signs the lease, they are agreeing to those conditions. Same thing with the smoking.

Now… if nothing is specifically stated in regards to those issues in your lease than the Tenant Act, or whatever you have there, is what would fill in the blanks.

So what I am saying is, if your Tenant agreed to the conditions of being a sole tenant and no smoking, he has legally bound himself to those conditions.

Good job with the mail thing. I think next time you should make a photocopy of the envelope with her name though so you can use it as evidence of him breaching the terms of the lease.

Is it a legal apartment? Does it comply with all the zoning, building, and fire regulations?
