Because the 49ers pick they acquired is not in control of the NFL, it was a business move between 2 NFL franchises. The standard 1-per-round draft pick that every team gets (which is the one the NFL revoked from the Patriots as part of the spying punishment), is under control of the NFL.
The Patriots will have the draft pick of whatever draft position the 49ers would have had in the first round this year, which is looking to be quite high.
