Assault Outside of Work

I appreciate the responses. Yes it looks like I’m fucked, what can ya do.
I did contact HR previously about him, so that may help somewhat. He also admitted to some, but not all of the previous incidents.
What he did to cause me to hit him: I work in a very hot country where air con is vital. The dial which controls the air con in both bedrooms is located in his room. He turned the air con up to the maximum setting & locked his door before going on holidays, which resulted in my room being like a sauna for a week & me getting no sleep. I also just had surgery for varicose veins 3 weeks prior to this. This incident I feel did not help the recovery. He has done this several times & this time I had enough. This has overall caused me a great deal of stress & anger.
Anyway I’m not optimistic about the outcome even though he 100% deserved the ass whooping he got. At least I’m not in jail!
Why didn’t you break open the door and adjust that AC yourself?

Yes hindsight is 20-20 but suffering through multiple, sleepless nights and letting this fester makes almost zero sense.

edit - Ok, I see you did contact HR about this (?) and nothing was accomplished. Perhaps you’re better off at a new company anyway. Best of luck with this, and going fwd.

Trying to break down his door was the first thing I did, however these are huge heavy set doors, I had second thoughts half way through & figured he could charge me with breaking & entering. However I wish I had continued, as what I ended up doing was much worse!
Yes I am much better off at a new company. This is the kick in the ass I needed to force me to move on. This company treats it’s employees like shit & works them to death. I will not be going down the attorney route, as to be honest I am not that concerned, I will get another job shortly. I spoke to my direct boss for references, he is great guy & will put a good word in for me.
However I still want to fight this to some extent myself as I had planned to stay with the company for another 3 months before moving on, partly because I had 3 weeks of paid holidays planned!! Appreciate the best wishes.

If this job is very important to you, get yourself an attorney and stop posting about this on T-Nation!
I’m surprised it took this long for this to get stated.

You should be showing up to your next meeting with your attorney. Even if your next meeting is Monday morning at 7am.
And show up with the lawyer unannounced, catch them off guard.

Sure you can.

Its called fucking their wife/sister/girlfriend/mum.

Hit em where it hurts most.

Update: Today was the supposed decision day. I had another 40 minute talk with the HR manager & he told me that they are still deciding & looking at evidence, the final outcome will be announced in 3-4 days & I am suspended from work with pay in the meantime. He said that he will be “as fair as possible” in making a decision & that the aggravation caused by the other guy will be “taken into consideration”. He stressed though that he is treating this as an assault first & foremost, which doesn’t sound too promising for me.
Would a dismissal usually take this long? The incident happened 4 days ago.

If I had to guess, I think you’re done.

He’s probably just covering all his bases from a legal standpoint in making sure the termination is just.

Your employer is now actually aware you assaulted someone, its arguably work related, and its been documented. The next time you assault someone and its arguably work related they know they are probably going to be legally on the hook for it. Barring a miracle, you might as well pack your bags and be thankful you have been suspended with pay.

Agree, termination is coming. The company is merely taking its time and doing its due diligence. No reason to leap about in a crazy reactive manner. You could learn from it, OP.

There are a MILLION ways to subtly or not so subtly to make someone’s life miserable when they are fucking with you - without ANY legal repercussions… Why on earth, in this day and age, would you punch someone in the face?

For goodness sake, AC, the guy had been strongly provoking the OP with several sneaky behind the back tactics for months. Did you not read the original post? What else could the OP do but punch the guy?

WTF with all the skimmers around here.

Dear God I click on a thread titled “Assault Outside of Work” and it’s the OP doing the assaulting.

This post made me spit out my drink. I hope you have a polite southern accent because then the post would be perfect.

LOL, Lets hear them!?
Seeing that I am more than likely fired anyway. He has gotten what he wanted, revenge would be sweet.

This all started simply because of him being a jealous prick over the amount of women I bang. At least I made him uglier than he already is. He’s already being shunned by most of the staff over what’s happening, I was a popular guy & most of the staff hated this prick anyway. So I guess he’ll get what’s coming to him AGAIN.
I’m more than likely going to get fired, so what can I do at this stage:

-Can I appeal the decision & get more suspended days with pay before they get rid of me completely?
-I’m pretty sure that I can resign instead of being fired?? I am on good terms with everyone eles in the company & hopefully they will let me do this so that it doesn’t affect fututre employment.

Who knew you were capable of such effective sarcasm? :-)
That was sarcasm?

Dangit. And I was all excited.

Why have you not yet contacted a lawyer and why are you continuing to ask T-Nation posters for advice?

Interviewer in your prospective employment/recruiter asks you : what was the reason for leaving your last job?

And your carefully worded reply is?

Cortes is right, you need a lawyer specialising in employment law, industrial relations, dispute resolution matters.
