Doesn’t the Senate have to confirm him ? Pretty sad that Bill Maher talked shit about Scalia last night.

I thought we’d emerge relatively unscathed from Obama’s Presidency but this is a huge game changer.

Only saving grace is that the Senate would never confirm an Obama appointee at this point.

As long as judges tinker with the Constitution to ‘do what the people want,’ instead of what the document actually commands, politicians who pick and confirm new federal judges will naturally want only those who agree with them politically.

I don’t think they could force a vote, they could paint Republicans with awful rhetoric like hating democracy, to which I would point at Hillary winning every super delegate even though Bernie won big in New Hampshire.

As for cases to be heard by SCOTUS, until a new appointee is approved, however the lower court ruled would stand until then.

I just read the longest it’s taken to confirm a new SCJ is 125 days. Obama is president for another 341 days.

Some of the pundits are saying Obama could possibly appoint a replacement during the January recess.

It’s very, very possible although would be a huge breach of political etiquette. That being said, all is fair in love, war, and Supreme Court appointments.

His passing terrifies me. Power has been concentrated in the executive and we have half of the country willing to elect a socialist. Couple those things with a liberal majority court and things could get ugly very quickly.

The Republicans don’t have the stones to hold up any appointment made by Obama. He could appoint Eric Holder tomorrow and they would confirm him by this summer. Its a damn shame.

It was a huge breach in political etiquette when Obama sold his healthcare law to the public as not being a tax, yet it was upheld by SCOTUS only because it was a tax.

Stalling until the election is perfectly fine in my book, don’t blame me because I played Chicago style politics better than the president from Chicago.

I think this will be a positive for Republicans, specifically Republican voter turnout.

Assuming the Senate doesn’t confirm an Obama nominee the next POTUS will have that opportunity. And loss aversion tells us that the pain from losing something you’ve had is significantly greater than the satisfaction attained by gaining that same thing.

While the Dems have an opportunity to gain influence on the USSC they didn’t previously have by turning out en masse this election, the Repubs will be losing a spot on the SC they previously had.

Republicans need to hammer this very point during the election, so long as Senate Pubs can hold their water and not cave.
